Request for an Audit

The Applicant respectfully submits that an audit is warranted in this matter for the following reasons.

First, according to the Yokohama City Board of Education's published “FY2026 Contract Results for the Dispatch of Assistant Language Teachers to Elementary Schools,” the contract is a major public procurement with a contract value of ¥1,143,961,987.

Second, the contracting party identified in that publication, Interac Kanto South Co., Ltd., was subsequently dissolved through an absorption merger. Accordingly, the manner in which Yokohama City administratively addressed the continuation of this public contract is a matter of substantial importance in determining whether public funds have been administered lawfully and appropriately.

Third, the Applicant is a party to an indefinite-term employment contract entered into on the premise of the existence of the Worker Dispatch Contract. Consequently, the continued existence and legal treatment of that Worker Dispatch Contract directly affect the Applicant's contractual rights and obligations.

Fourth, the factual circumstances surrounding this matter constitute important issues in multiple civil proceedings presently pending before the Tokyo District Court. Clarifying the administrative handling of the contract is therefore essential to establishing the underlying facts relevant to those proceedings.

Fifth, on July 24, 2026, the Applicant submitted a report to the Minister of Health, Labour and Welfare pursuant to Article 49-3 of the Worker Dispatching Act.

That report requests that the Ministry investigate possible issues arising under the Worker Dispatching Act and take such administrative action as may be appropriate.

By contrast, this Request asks the Representative Auditor to verify the legal basis and procedural propriety of Yokohama City's contract administration and administrative processing. These are matters falling within the jurisdiction of different public authorities and serve different administrative purposes.

The Applicant respectfully submits that, if Yokohama City lawfully succeeded to or continued the contract through appropriate administrative procedures, confirmation of those administrative determinations is of critical importance both to the Applicant's contractual status and to the civil proceedings presently pending before the Tokyo District Court.

Conversely, if no such administrative procedures exist, that fact itself raises questions requiring examination concerning the proper administration of public contracts and the lawful expenditure of public funds.

For these reasons, the Applicant respectfully requests that the Representative Auditor conduct an audit of this matter and undertake such factual investigation as may be necessary.
